While a formal deal is expected to be announced tomorrow on the Hobet 45 mountaintop removal permit, the Obama administration is asking a federal judge for more time to negotiate with Arch Coal Inc. over the largest mountaintop removal permit in West Virginia history.
Federal government lawyers just filed a request with U.S. District Judge Robert C. Chambers asking to extend a stay in proceedings over Arch Coal’s Spruce Mine for another 60 days.
They told Judge Chambers that “significant progress has been made,” but that an “agreement has not yet been reached.”
Recall that EPA has begun proceedings to veto the Army Corps of Engineers’ approval of this permit, and Arch Coal has asked Judge Chambers to throw out of court a pending citizen group challenge to that Corps’ permit approval.
